Primary Practice Areas

Administration of Deceased Estates

A deceased estate comes into existence when a person passes away. The estate must be administered in accordance with the provisions of the Administration of Estates Act, 66 of 1965. It is therefore important the your Executor is a person with specialized knowledge in the field of administration of deceased estates. The estate must be reported to the Master of the High Court and if the estate’s value exceeds R 250 000.00 a Letters of Executorship will be issued, alternatively a Letters of Authority is issued for estates with a value of less than R250 000.00.  This appointment will then allow the Executor to commence the formal administration procedure as prescribed by the Act, under supervision and final approval of the Master of the High Court.

Drafting of Wills

A Will is a specialised document in which a person (or couple) sets out what must happen to their estate when they pass away. A person’s estate consist of all the persons assets and liabilities on date of death.  In a Will a person will also nominate an Executor who should administer their estate and assist their family with all the legal procedures upon their passing. A Will should preferably be drawn up by an Attorney as there are many formal legal requirements which it must comply with in order to be valid. A Will allows you to decide who should be the beneficiaries of your estate, and if you have minor children this is how you appoint a Guardian when you are no longer there to care for them. Your signed original Will should be kept in a place of safety, for example with your Attorney.

Property Law

Property law is the area of law that governs the rights and duties of individuals or entities that own personal or fixed property.

We can advise you regarding your rights when purchasing and selling property. Each time a property is sold, a transfer of legal title takes place, and a new deed of transfer must be drawn up and the property must be registered in the new owner’s name in the Deeds Office.

Our Conveyancing experts will assist you and attend to the formal legal process of registering your transaction in the Deeds Office.

Law of Contract

Contract Law provides a framework which regulates transactions, dealings and relationships between parties. It stipulates all rights and obligations arising from the specific agreement between the parties. It ensures that when parties enter into the contract their intentions are similar and all material aspects of the agreement have been discussed and agreed upon. For a contract to be valid, certain legal requirements must be met. If you wish to enter into a contract we strongly advise that you seek professional advice and assistance in drafting the contract that suits your specific needs. Not only will this result in a fair contract being drafted and all parties interests protected, but it will also ensure that both parties will fulfil their obligations as promised.
